eBikeGo Vehicle Rental Agreement

1. Vehicle Rental and Acceptance

• eBikeGo agrees to rent to the Renter, and the Renter agrees to rent from eBikeGo, the electric vehicle described as [Vehicle Description, including Make, Model, and Vehicle Identification Number (VIN)] (hereinafter "Vehicle").
• The Renter acknowledges that they have inspected the Vehicle and found it to be in good working order and suitable for their intended use.

5. Theft and Loss

• The Renter shall take all reasonable precautions to prevent the theft or loss of the Vehicle.
• In the event of theft, the Renter shall immediately notify eBikeGo and the local police.
• The Renter shall be liable for the full replacement cost of the Vehicle in the event of theft due to the Renter's negligence.

6. Damage and Liability

• The Renter shall be responsible for any damages to the Vehicle during the Rental Period, regardless of fault.
• The Renter agrees to indemnify and hold eBikeGo harmless from any claims, liabilities, or expenses arising from the Renter's use of the Vehicle, including but not limited to:
  • Personal injury or property damage to third parties.
  • Traffic violations.
• The Renter is responsible for all fines and penalties incurred while the Vehicle is in their possession.
• eBikeGo provides minimum legal insurance. Any further insurance is the responsibility of the Renter.

7. Brand Protection

• The Renter shall not engage in any conduct that may damage the reputation or brand name of eBikeGo.
• Any false or misleading statements made by the Renter about eBikeGo or its services shall be considered a material breach of this Agreement.
• eBikeGo has the right to pursue legal action against any renter who damages the brand, including but not limited to financial compensation for damages caused to the brand.

8. Termination

• eBikeGo may terminate this Agreement immediately upon the Renter's breach of any provision herein.
• Upon termination, the Renter shall return the Vehicle to eBikeGo immediately.

9. Legal Action and Penalties

• Theft: Any Renter who steals a Vehicle from eBikeGo will be prosecuted to the fullest extent of the law. They will be held financially responsible for the full replacement cost of the Vehicle and any associated legal fees.
• Damage: Renters who cause intentional or negligent damage to eBikeGo Vehicles will be held financially responsible for the repair or replacement costs.
• Brand Damage: Renters who intentionally damage the brand name of eBikeGo through slander, libel, or other means will be pursued for financial compensation to cover the damages caused to the brand.
• Violations: Fines and penalties for violations of this Agreement will be determined by eBikeGo and will be in accordance with local laws.
• eBikeGo reserves the right to pursue any and all legal remedies available to it.

10. Data Privacy

• The Renter consents to eBikeGo's collection and use of their personal information and GPS data for rental purposes and to enforce this Agreement.

11. Governing Law and Jurisdiction

• This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction].
• Any disputes arising from this Agreement shall be resolved in the courts of [Jurisdiction].

12. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.

13. Digital Signature

• By digitally signing this Agreement, the Renter acknowledges that they have the legal capacity to enter into this Agreement and that their digital signature shall have the same force and effect as a handwritten signature.
