eBikeGo Vehicle Rental Terms and Conditions

1. Definitions:

  • "eBikeGo": Refers to eBikeGo and its affiliates.
  • "Renter": Refers to the individual or entity renting the vehicle.
  • "Vehicle": Refers to the electric bike or scooter rented from eBikeGo.
  • "Rental Period": Refers to the agreed-upon duration of the rental.
  • "Security Deposit": Refers to the refundable amount paid by the Renter.
  • "Damages": Any physical or mechanical damage to the Vehicle.
  • "Unauthorized Use": Any use of the Vehicle not permitted by these terms.

2. Rental Agreement:

  • The Renter must possess a valid driver's license and government-issued identification.
  • The Renter must be at least 18 years of age.
  • The Rental Agreement is non-transferable.
  • The Renter agrees to pay the rental fees and any applicable charges.
  • The Renter acknowledges receipt of the Vehicle in good working order.

3. Security Deposit:

  • A Security Deposit is required before the Rental Period begins.
  • The Security Deposit will be refunded upon the safe return of the Vehicle, less any deductions for Damages or unpaid charges.
  • eBikeGo reserves the right to withhold the Security Deposit in case of theft, severe damage, or violation of these terms.

4. Vehicle Use and Restrictions:

  • The Vehicle must be used responsibly and in compliance with all traffic laws.
  • Unauthorized Use includes, but is not limited to:
    • Using the Vehicle for racing or competitions.
    • Carrying passengers exceeding the Vehicle's capacity.
    • Towing or pushing other vehicles.
    • Using the Vehicle under the influence of alcohol or drugs.
    • Subletting or lending the Vehicle to others.
    • Using the Vehicle for any illegal activity.
    • Modifying the vehicle in any way.
  • The Renter is responsible for the Vehicle's battery charging and maintenance during the Rental Period.
  • The Renter must park the vehicle in safe and secure locations.

5. Theft Prevention:

  • The Renter is responsible for the Vehicle's security during the Rental Period.
  • The Renter must use the provided locking mechanisms and any other security features.
  • The Renter must not leave the Vehicle unattended in high-risk areas.
  • In case of theft, the Renter must immediately notify eBikeGo and the local police.
  • The Renter will be held liable for the cost of the vehicle in the event of theft due to negligence of the renter.

6. Damage and Liability:

  • The Renter is responsible for any Damages to the Vehicle during the Rental Period, regardless of fault.
  • The Renter must report any Damages immediately to eBikeGo.
  • eBikeGo will assess the Damages and determine the repair costs.
  • The Renter agrees to pay for the repair costs or the replacement value of the Vehicle, if applicable.
  • eBikeGo is not liable for personal injuries or property damage unless caused by negligence.

7. Termination of Rental Agreement:

  • eBikeGo reserves the right to terminate the Rental Agreement at any time for violation of these terms.
  • In case of termination, the Renter must return the Vehicle immediately.
  • eBikeGo may retain the Security Deposit to cover any outstanding charges.

8. Data Privacy:

  • eBikeGo may collect and use the Renter's personal information for rental purposes and to improve its services.
  • eBikeGo will comply with applicable data privacy laws.
  • GPS data will be collected and retained during the entire rental period.

9. Governing Law:

  • These terms and conditions are governed by the laws of [Jurisdiction].
  • Any disputes will be resolved in the courts of Mumbai Jurisdiction.

10. Amendments:

  • eBikeGo reserves the right to amend these terms and conditions at any time.
  • The Renter will be notified of any changes.

11. Return of Vehicle:

  • The Vehicle must be returned to the designated eBikeGo location at the end of the rental period.
  • The Vehicle must be returned in the same condition as received, except for normal wear and tear.
  • Late returns will incur additional charges.

12. GPS Tracking:

  • The Renter acknowledges that the Vehicle is equipped with GPS tracking for security and monitoring purposes.
  • eBikeGo may use GPS data to locate the Vehicle in case of theft or unauthorized use.

13. Insurance:

  • eBikeGo will provide the minimum legal insurance required.
  • The Renter is responsible for any additional insurance coverage they may require.

14. Emergency Procedures:

  • The Renter must immediately contact eBikeGo in case of an emergency.
  • The Renter must follow eBikeGo's instructions and cooperate with emergency services.

15. Acknowledgement:

  • By renting a Vehicle from eBikeGo, the Renter acknowledges that they have read, understood, and agreed to these terms and conditions.
